Terms and Services:

  1. US HOME COMFORTS COMMITMENTS: I understand that under the terms of this Furnace/Air Conditioner Application (“Application”), US Home Comfort, LLC, doing business in Texas as US Home Comfort (“USHC”) will install the heating, ventilating, and/or air conditioning equipment (“HVAC”), thermostat, and/or related equipment with specifications outlined on the cover page of this Agreement (“the Equipment”) in a good and workmanlike manner in accordance with the good professional practices applicable to the industry and that the Equipment will be installed by USHC at the address specified on the cover page of this Agreement (the “Residence”) as close to the scheduled installation date as possible and no later than thirty (30) days from that date unless I otherwise agree. The date on which the Equipment is installed shall be the “Installation Date”.
  2. TERM AND PAYMENTS: This Agreement is conditional upon USHC’s acceptance of it, and USHC’s acceptance depends, in part, on whether I am credit-wor- I agree to purchase the Equipment from USHC effective from the date this Agreement is signed. I understand that I will be billed the monthly payment amount specified on the cover page of this Agreement. Unless otherwise specified on the cover page, the first periodic payment will be billed by Synchrony Financial, Red Brick Financial, and/or Turns Financial in the first eligible billing period following my Installation Date.
  3. SERVICE AND MAINTENANCE: USHC will provide a 10-year limited labor warranty on certain packages as identified at the time of purchase. All other labor warranties are limited to a one-year period from the date of installation. Part of this agreement This warranty shall include reasonable service calls after initial troubleshooting attempts through our customer service department are unable to resolve the A technician will visit the customers’ property where the installation was performed within 24-48 hours of scheduling the appointment under reasonable circumstances. All repairs will be covered by USHC should they pertain to the natural or unforeseen breakdown of equipment or lack of quality workmanship. All parts that are covered under the manufacturer’s warranty will be replaced according to the manufacturer’s policies. any additional labor or parts needed (outside of parts covered in the manufacturer’s warranty) will be the sole responsibility of the consumer and the customer shall be quoted separately. I understand that all installation, maintenance, and repairs to the Equipment must be performed by US Home Comfort or an authorized USHC technician and that should any other individual attempt to install, remove (except as may be permitted in Section, modify, repair or tamper with the Equipment, the 10-year limited labor warranty described above will be void, and USHC may terminate the Agreement and/or charge me for the costs of any labor and materials related to any repairs, servicing or maintenance required to be carried out, as determined by USHC, acting reasonably. I understand that I am responsible for purchasing and replacing filters for the Equipment at least once every four months. I understand that I am liable for any damages resulting from the failure to replace filters at least once every four months. A service fee may be charged to my account if a service call is not related to the Equipment ($150) or if no one is home when the USHC technician arrives for a scheduled service call ($75).
  4. FILTER AND EXTENDED COVERAGE PLAN: I understand upon choosing the Filter and Extended Coverage monthly plan I will receive 1 filter per Furnace/Air Handler sent or delivered to my home once every 4 months (3 times annually). Filter size and specification to be provided by the customer at the time of enrollment. The customer acknowledges that in the case where a wrong filter size is provided and the wrong filter is delivered to the customer, the filter will not be replaced by USHC. Should the customer decide to request a filter replacement the customer will be responsible for the fee charged by USHC. The extended coverage portion of this option covers the following:

    1. Priority service calls where the $150 standard service call is waived regardless of the reason for a visit even if the issue is outside of warranty parameters
    2. 15% discount on all future or additional purchases of USHC products
    • 15% discount on all work performed on customers’ equipment outside of warranty parameters.
  5. OWNERSHIP AND INTEREST: I understand that upon the installation of the equipment I am the sole owner of the equipment and am responsible for the reasonable upkeep and maintenance of the equipment. If the equipment is financed through Synchrony Financial Or Turns Financial, all payments and interests are payable.
  6. MY COMMITMENTS AND ASSURANCES: I have authority to enter into this Agreement because I am either the owner of the Residence or have been authorized by the owner of the Residence to sign this Agreement on their behalf. If anyone else is named on the title, then each of us will be responsible for all obligations in this Agreement. I will use the Equipment safely and responsibly and, in particular, will ensure that: (i) no combustible, hazardous, or flammable materials are used or stored near the Equipment; (ii) the Equipment will not be confined in a location where it is difficult to service or remove or where there is inadequate ventilation; (iii) the vents and openings are kept clear and clean; and (iv) I will provide USHC with access to the Equipment whenever reasonably required for purposes of inspection, repair or removal. I understand that it is my responsibility to ensure that the Equipment is located in an area with sufficient drainage in the vicinity and that the drainage is open and unrestricted and I will not hold USHC responsible for damage caused if the Equipment leaks or otherwise malfunctions. I will be responsible for any damage to the Equipment if caused by me or unauthorized third parties or by fire, flood, accident, or other insurable risks.

  7. SALE OF THE RESIDENCE: I understand that if I sell my Residence during a Finance Term, I will personally be responsible for any monies owed based on ÿnance agreements through Synchrony Financial and/or Turns Financial. I understand that I am able to pay o˛ any remaining balance at any time with no early /prepayment penalties to the above-mentioned ÿnancial organizations.

  8. INSTALLATION AND OTHER CHARGES ˙PLUS APPLICABLE TAXESˆ: I understand that upon execution of this Agreement, USHC has waived the entire installation and removal charges as mentioned on the front of this agreement. I agree that I have the option to not accept the offer and prepay the installation, however, in doing so I forgo the 10-year limited labor warranty offered by USHC if applicable.

  9. LIABILITY: I understand that USHC is not the manufacturer of the Equipment and therefore makes no representations, warranties, or conditions as to the performance of the Equipment, except those which are given by statute and which cannot be waived. USHC will not be liable for any loss, damage, or injury of any type (including as a result of any water leakage) arising out of or related to this Agreement or caused or contributed to in any way by the use and operation of the Equipment or any indirect, incidental, special or consequential damages, even if reasonably foreseeable. If USHC is unable to perform any of its obligations under this Agreement because of circumstances or events beyond its control, it shall be excused from the performance of such obligations for the duration of such circumstances or events and it shall not be liable to you for such failure to perform. I will indemnify USHC from any loss or damage to the Equipment for any reason (other than normal wear and tear) and all claims, losses, and costs that USHC may suffer or pay, or may be required to pay, including legal expenses, in connection with the Equipment, this Agreement or the use and operation of the Equipment, including any claims against it for any injury or death to individuals or damage to property.

  10. MISCELLANEOUS: This Agreement is the entire agreement between me and US Home Comfort, LLC. It is governed by the laws of the State Of Texas and the laws of the United States OF America applicable therein. Should any of the terms and conditions in this Agreement be held invalid for any reason by a Court or regulatory body of competent jurisdiction, then such terms or conditions shall be deemed severed from this Agreement and the remaining terms and conditions shall continue in full force and effect. Neither the failure nor delay of USHC to exercise any right or to enforce any term of this Agreement shall be construed as a waiver of such right or term or of any other right or term hereunder. USHC further reserves the right to decline service to any customer at any time at its sole discretion.

  11. PRIVACY POLICY: I understand that USHC may use email to communicate with me, to send me the information I have requested, or to send me notiÿcations pertaining to this I understand that my personal information included with the application form and my account, credit, and billing history will be collected, used and maintained for the purposes of managing my account with USHC. I understand that USHC may provide my credit history and personal information to its lenders or a credit bureau for the purpose of managing its or its lenders’ risk. I understand that USHC may disclose my personal information if this Agreement is transferred or assigned, as otherwise required to collect a payment owed by me, or as required by law. I will be provided with the opportunity to receive offers from USHC’s affilates and/or its business partners, and can opt-out of receiving these o˛ ers at any time. to the mentioned organizations and not to USHC; therefore  I am bound to the terms and conditions for the mentioned financial institutions.
